Except for housing, Buffett is a bull among bulls

Anyone looking for more evidence of a strengthening U.S. economic recovery need only consider conglomerate Berkshire Hathaway, where businesses ranging from railroads and electric utilities to furniture and candy stores are racking up record profits.

Even though Berkshire's Warren Buffett says with emphasis that the housing market is still in a depression, he was as upbeat as ever this weekend on the rest of the dozens of businesses he owns.

"Though housing-related businesses remain in the emergency room, most other businesses have left the hospital with their health fully restored," Buffett said on Saturday in his closely watched annual letter to shareholders.

Berkshire's five largest non-insurance businesses, all of them industrial in some way, posted record profits last year and should do the same this year, he said, surpassing $10 billion in combined earnings.

That being the case, Berkshire broke its own records for capital spending in 2011 by a wide margin and expects to do so again in 2012 - almost all of it domestically, even with the company's global footprint.

"About 95 percent of these outlays were made in the U.S., a fact that may surprise those who believe our country lacks investment opportunities. We welcome projects abroad, but expect the overwhelming majority of Berkshire's future capital commitments to be in America."

There are other big investments on tap, too. Buffett said his home-furnishings retailer, Nebraska Furniture Mart, bought a 433-acre parcel north of Dallas and will construct what it expects to be the highest volume store of its kind anywhere. He also forecast billions of dollars in spending on solar and wind energy projects.

Investors who have been with Buffett over the long term expected his optimism.

"That's not surprising," said Michael Yoshikami, CEO of Destination Wealth Management, in California, noting in particular Buffett's sense that the banking business is back in shape. "He's obviously a believer in the financial sector being a key to the overall economy."

Buffett sounded a similar tone in 2011.

"I don't see how anybody can be other than enthused about this country," Buffett told Berkshire shareholders last year at the company's annual meeting, even as the country was in the middle of a crisis over its debt ceiling and credit ratings.

Nonetheless, at this delicate stage in the U.S. economic recovery, his words carry weight, partly because of his successes over the years and partly from the sheer size and scope of Berkshire, which employees more than 270,000 people in nearly 80 businesses.

That gives him a view into many of the same factors policymakers consider when they try to figure out what to do next with the sluggish economy.

Federal Reserve officials have noted lately that while the economic recovery is tepid, there is sufficient evidence that things are picking up to warrant holding off on further stimulus measures.

Buffett's optimism is not confined to industry. He said that "the banking industry is back on its feet" and singled out two of his favorite investments, Wells Fargo and Bank of America.

He also took a fair bit of space in the letter to call into question the value of bonds and commodities as investments, and to praise his own favorite category, "productive assets" like businesses and real estate.

"Ideally, these assets should have the ability in inflationary times to deliver output that will retain its purchasing-power value while requiring a minimum of new capital investment. Farms, real estate, and many businesses such as Coca-Cola, IBM and our own See's Candy meet that double-barreled test," he said.

If there is one sore spot, it is the housing market. A year ago, Buffett said he expected the housing sector to recover within a year or so. He acknowledged that call turned out "dead wrong."

Berkshire's five housing-related businesses were profitable the past two years, but at a level two-thirds less than they were in 2006. They have shed 26 percent of their staff over that time, more than 15,000 people in total.

As he has in the past, Buffett said the problem was an excess of supply and no one to soak it up. On Saturday, he proposed that lust, of all things, would solve the problem eventually.

"Every day we are creating more households than housing units. People may postpone hitching up during uncertain times, but eventually hormones take over. And while 'doubling-up' may be the initial reaction of some during a recession, living with in-laws can quickly lose its allure."

Apple launches new attack on Samsung phones

Apple has asked a federal court in California to block Samsung Electronics from selling its new Galaxy Nexus smartphones, alleging patent violations.

In a suit filed last week in San Jose, Apple said the Galaxy Nexus infringes on patents underlying features that customers expect from its products. Those include the ability to unlock phones by sliding an image and to search for information by voice.

Samsung representatives did not immediately return requests for comment.

With the new suit, Apple is opening up another legal assault on the Korea-based company after taking Samsung to the same court in April of last year. In the earlier case, Apple alleges that Samsung illegally copied iPhone and iPad design features and the look of its screen icons. That case is still going on, though in December Apple lost a bid for a preliminary bar that would have kept Samsung from selling Galaxy phones and tablets.

Apple acknowledged the setback in the new action and said it is now suing over new products and different patents.

In addition to the California cases, Apple and Samsung are waging more than 20 legal fights in at least 10 countries in their war for global leadership of smartphone and tablet markets.

The new case in U.S. District Court, Northern District of California, is Apple Inc v. Samsung Electronics Co Ltd, et a 12-00630.

?There have been problems with regard to Iran?s nuclear program,? Prime Minister Manmohan Singh told reporters after meeting with the president of the European Union. ?We sincerely believe that this issue can be and should be resolved by giving maximum scope to diplomacy.?

EU President Herman Van Rompuy said he would ask Singh to use India?s leverage to help bring Iran back to the negotiating table.

Iran is India?s second-largest crude oil supplier after Saudi Arabia and according to media reports imports 550,000 barrels a day. Sanctions on Iran had long made that trade difficult, because Indian oil importers had to scramble to find banks willing to handle transactions with Tehran.

But last week, Iran?s ambassador to India said the two countries had reached an agreement to make the trade easier. Under the agreement, India will make 45 percent of its payments for Iranian crude oil in rupees and pay the rest by investing in Iranian infrastructure projects. Iran, meanwhile, will use those rupees to buy Indian goods, including machinery, iron, steel, minerals and automobiles, said Ambassador Seyed Mehdi Nabizadeh.

A large delegation of Indian trade officials will travel to Tehran later this month to help Iran identify Indian goods and services that it can import.

WASHINGTON (AP) ? President Barack Obama is pressuring Congress to extend a payroll tax cut for the rest of the year as another deadline nears for Congress to act or see taxes go up for millions of working people.

Lawmakers agreed in December, after much bickering, on a two-month extension, but that runs out at the end of this month. Obama said in his weekly radio and Internet address Saturday that Congress "needs to stop this middle-class tax hike from happening. Period. No drama. No delay."

Obama said the economic recovery must not be jeopardized by a failure to stop payroll taxes from rising, and he urged listeners to add their voices.

"I hope you'll pick up the phone, send a tweet, write an email, and tell your representative that they should get this done before it gets too late. Tell them not to play politics again by linking this debate to unrelated issues. Tell them not to manufacture another needless standoff or crisis," Obama said. "Tell them not to stand in the way of the recovery. Tell them to just do their job. That's what our middle class needs. That's what our country needs."

Lawmakers have made halting progress on legislation to extend the tax cut. The bill also would renew jobless benefits for the long-term unemployed and prevent doctors from a 27 percent cut in their Medicare payments. But the plan costs $150 billion-plus and lawmakers will have to find a way to pay for it.

The 2 percentage point cut in Social Security taxes is worth about $1,000 per year for the average family, or $40 per paycheck.

In the Republican radio address, Virginia Gov. Bob McDonnell applauded efforts by Republican governors across the country to contain government spending and reduce their state budget deficits. Speaking ahead of Obama's release Monday of his 2013 budget, McDonnell said the federal budget will impede job creation by calling for tax increases and for continuing the administration's health care policies.

Obama's budget would allow Bush-era tax cuts for people in the upper brackets to expire. It also is expected to call for the elimination of corporate tax loopholes while calling for lower corporate tax rates.

McDonnell said Republicans can help create an environment that creates and sustains private sector jobs.

"We know that when we limit government to free up capital, and reduce onerous regulations and litigation, we spur private sector job creation."

Miss. executes man who was said to be mentally ill

Edwin Hart Turner was executed Wednesday despite lawyers' pleas that he was mentally ill.

PARCHMAN, Miss. -- A Mississippi inmate has been put to death for killing two men in a December 1995 robbery spree after?courts declined to stop the execution based on arguments that he was mentally ill.

Edwin Hart Turner, 38, was administered a lethal injection and died at 6:21 p.m. CST at the Mississippi State Penitentiary at Parchman, authorities said. The inmate was convicted of killing the two men while robbing gas stations with a friend, Paul Murrell Stewart, in a spree that netted about $400. Stewart, 17 at the time, testified against Turner and was sentenced to life in prison.

Turner was strapped on a gurney wearing white shoes and one of the red prison jumpsuits issued to death row inmates. When a microphone was lowered to his mouth, he said, "No" when asked if he had a final statement. Then the chemicals began flowing through tubes into his body. He closed his eyes, took a deep breath and had the appearance of falling asleep.

Turner was convicted of capital murder in the deaths of Eddie Brooks and Everett Curry. Brooks was shot to death while working at Mims Turkey Village Truck Stop in Carroll County. Curry was shot to death while pumping gas at the nearby Mims One Stop.

Mississippi Department of Corrections spokeswoman Suzanne Singletary said a sister and cousin of victim Eddie Brooks watched the execution. The brother and son of his other victim, Everett Curry, also witnessed it. They were escorted out of the witness room after the execution, saying nothing as they were led away. Turner had requested that none of his family watch the execution, though two of his attorneys were listed to be witnesses.

The U.S. Supreme Court refused late Wednesday to block the execution. Earlier in the day, Gov. Phil Bryant had refused to grant a reprieve, saying after a review of the case, "I have decided not to grant clemency for his violent acts."

Earlier, Turner's lawyers had objected to the pace of events in the scheduling of the execution.

"Execution was set in this case with only 13 days' notice ? a procedure that would be illegal in most other states. Mississippi has created a time crunch and forced both the courts and the Governor to respond to this most serious of cases with inadequate time and consideration," said Richard Bourke, director of the Louisiana Capital Assistance Center.

James Craig, another LCAC attorney representing Turner, had persuaded U.S. District Judge Carlton Reeves on Monday to temporarily block the execution after arguing a Department of Corrections policy prevented Turner from getting tests that could prove he was mentally ill when he killed the two men.

That petition said Mississippi is one of 10 states that permit someone who suffered from serious mental illness at the time of the offense to be executed. Turner's lawyers wanted the court to prohibit the execution of mentally ill people as it did with inmates considered mentally retarded.

On Wednesday, the 5th U.S. Circuit Court of Appeals in New Orleans overturned the stay.

Corrections Commissioner Chris Epps said Turner was talkative in the hours before the execution Wednesday but declined to discuss the crimes for which he was sentenced to death.?Asked if Turner seemed mentally ill, Epps said of the visit with the prisoner in those final hours: "No, not to me. He appears to be on the ball."

There's little dispute that Turner killed two men while robbing gas stations, then went home and had a meal of shrimp and cinnamon rolls before going to sleep.

Turner's lawyers argued in the petition to the U.S. Supreme Court that he inherited a serious mental illness. They argued that his father is thought to have committed suicide by shooting a gun into a shed filled with dynamite and his grandmother and great-grandmother both spent time in the state mental hospital.

Argentina is slamming Prince William's deployment to the Falklands. Some Argentine veterans say the move is aggressive and arrogant, but most residents on the islands are preparing to welcome the Prince. ITN's Bill Neely reports.

Argentina?s government plans to lodge a complaint with the United Nations over ?militarization? of the South Atlantic,?Argentine President Cristina Fernandez de Kirchner announced on Tuesday.

"Malvinas is no longer an Argentine cause, it's now a Latin American cause, a global cause," Fernandez?said, calling the Falkland?Islands?by the name they're known by in Argentina.

Fernandez?said she wants peace with?in the region and "democracy and sovereignty" in the?islands,?according to an English translation published by the Buenos Aires Herald.
